1. Acceptance of Terms
By accessing or using the services provided by LVL OTP Engine ("Company," "we," "our"), including our website, APIs, dashboards, and OTP delivery infrastructure (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
2. Description of Services
LVL OTP Engine provides cloud-based authentication and OTP (One-Time Password) delivery services, including but not limited to:
- SMS OTP delivery via global carrier networks.
- WhatsApp-based OTP and verification message delivery.
- Multi-factor authentication (MFA) solutions.
- Fraud detection and prevention tools.
- RESTful APIs and SDKs for integration.
3. Account Registration
To use our Services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials, including API keys, and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Services to send unsolicited messages (spam) or for any purpose unrelated to legitimate authentication and verification.
- Attempt to circumvent rate limits, security controls, or abuse prevention mechanisms.
- Reverse-engineer, decompile, or disassemble any part of the Services.
- Use the Services in any way that violates applicable local, national, or international laws or regulations.
- Resell, sublicense, or redistribute the Services without prior written consent.
- Transmit malicious code, viruses, or any harmful content through the Services.
5. Pricing and Payment
Service fees are based on the pricing plan selected at registration and are subject to change with 30 days' prior notice. All fees are non-refundable unless otherwise stated. We may suspend or terminate your account if payment is overdue by more than 15 days.
Usage is billed monthly in arrears based on the number of OTP messages delivered, API calls made, and any additional features utilized. Detailed invoices are available through your dashboard.
6. Service Level Agreement
We commit to a 99.9% uptime guarantee for our core OTP delivery infrastructure, measured on a monthly basis. In the event of downtime exceeding this threshold, eligible customers may request service credits as outlined in our SLA documentation. Scheduled maintenance windows are excluded from uptime calculations.
7. Intellectual Property
All content, features, trademarks, and technology comprising our Services are owned by LVL OTP Engine and are protected by intellectual property laws. Your use of the Services does not grant you any ownership rights. You retain ownership of your data and content submitted through the Services.
8. Data Processing
We process personal data (including phone numbers and OTP content) on your behalf as a data processor. You remain the data controller and are responsible for ensuring you have appropriate consent and legal basis for processing end-user data through our Services. Our data handling practices are described in our Privacy Policy.
9. Limitation of Liability
To the maximum extent permitted by law, LVL OTP Engine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services. Our total aggregate liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless LVL OTP Engine, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
11. Termination
Either party may terminate the agreement at any time with 30 days' written notice. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Services ceases, and we may delete your account data after a 30-day grace period.
12. Governing Law
These Terms are governed by the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be resolved through arbitration in Jakarta, Indonesia, in accordance with the rules of the Indonesian National Arbitration Board (BANI).
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our dashboard at least 30 days before they take effect. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
